Terms of Service

1. Acceptance of Terms
By accessing or using Feedash ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to all terms, you may not use the Service. The Service is operated by Het Ondernemers Kompas, Simon Stevinweg 27, 6827 BS Arnhem, The Netherlands.
2. Description of Service
Feedash is a visual feedback platform that allows users to collect, manage, and resolve website feedback through pin-based comments, team collaboration, and client share links.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload or transmit viruses or malicious code
- Attempt to gain unauthorized access to other users' accounts
- Interfere with or disrupt the Service's infrastructure
- Use the Service to collect information about others without consent
- Resell or redistribute the Service without authorization
5. Your Content
You retain ownership of all content you create through the Service, including feedback comments, project data, and uploaded files. By using the Service, you grant us a limited license to store, display, and process your content as necessary to provide the Service.
6. Intellectual Property
The Service and its original content, features, and functionality are owned by Het Ondernemers Kompas and are protected by international copyright, trademark, and other intellectual property laws.
7. Payment and Billing
Paid plans are billed in advance on a monthly or annual basis. All payments are processed securely by Stripe, Inc. By subscribing to a paid plan, you also agree to Stripe's Terms of Service. You may cancel at any time, and your subscription will remain active until the end of the billing period. Refunds are not provided for partial billing periods.
8. Data Processing
If you use Feedash to collect feedback that involves personal data of individuals (such as client names or end-user information), you act as the data controller and Feedash acts as the data processor. A Data Processing Agreement (DPA) is available for business customers and can be accessed at feedash.com/dpa.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance or updates that temporarily affect availability. We will make reasonable efforts to notify users of planned downtime.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Het Ondernemers Kompas shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or goodwill.
11. Termination
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will cease immediately. All provisions that should survive termination will survive.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands. Het Ondernemers Kompas is the legal entity responsible for the operation of Feedash.
